These are the terms and conditions on which we supply our products to you through senditmotorsport.com.

Please read these terms carefully before placing an order. They tell you who we are, how we will provide products, how you and we may end the contract, what to do if there is a problem and other important information. If you think there is a mistake in these terms, please contact us.

We may revise these terms and conditions at any time by posting the revised version on our website. The terms in force at the time you place your order will apply to that purchase.

1. General Information

1.1 About Us. We are Revive and Drive S.R.L., a Romanian limited liability company trading as Send It Motorsport.

1.2 How to contact us. You can reach us by:

1.4 Scope of these Terms. These Terms and Conditions (“Terms”) govern your use of the website senditmotorsport.com (the “Website”) and all purchases made through it. They apply to both consumers (natural persons acting outside their trade, business, craft or profession) and non-consumers (business customers).

By accessing or using the Website, browsing products, or placing an order, you confirm that you have read, understood and agree to be bound by these Terms in full. Acceptance is voluntary but necessary to place an order and conclude a distance sales contract.

1.5 Changes to the Terms. We reserve the right to update or amend these Terms at any time. The version published on the Website at the time you place your order applies to that order. We recommend checking this page regularly for updates.

In case of any dispute or misunderstanding, the Terms valid at the moment of order placement shall prevail.

1.6 Technical requirements. To use the Website properly, your device and browser must meet minimum technical standards (modern browser with JavaScript enabled, stable internet connection). We are not responsible for any issues arising from incompatible equipment or software.

1.7 Product information. All product descriptions, images, specifications and prices on the Website are provided for information purposes only and constitute an invitation to treat, not a binding offer to sell. A binding sales contract is concluded only when we send you an order confirmation email.

1.8 Order placement & contract conclusion. Placing an order is a binding offer from you to purchase the selected products. The contract is formed only upon our written acceptance (order confirmation email). We reserve the right to refuse or cancel any order (e.g. due to stock unavailability, pricing errors, suspected fraud, or other legitimate reasons) and will notify you promptly.

1.9 Payment All prices are in Romanian Leu (RON) and include 21% VAT unless stated otherwise. Payment is made online via secure methods (e.g. card via Stripe). We do not store full card details. We are not responsible for additional fees (e.g. currency conversion fees charged by your bank).

1.10 Assignment & subcontracting We may assign or subcontract any part of the order fulfilment (e.g. to delivery partners) while remaining fully responsible towards you for proper performance of the contract.

1.11 Fraud prevention Any attempt at fraud (unauthorised access, data alteration, fake orders, etc.) will be reported to the competent authorities and may result in civil and/or criminal liability under Romanian law.

2. Placing an Order

2.1 How you can place an order. Orders are placed through our website senditmotorsport.com.

To order:

  • Add the desired product(s) to your shopping cart by clicking “Add to Cart”.
  • Review your cart: edit quantities, remove items, or continue shopping.
  • Proceed to checkout and enter your contact details, delivery address, billing information (if different) and preferred payment method.
  • Carefully review your entire order (products, quantities, delivery address, total price, etc.) before clicking “Complete Order” or “Pay Now”.

We strongly recommend double- and triple-checking all details before confirming, as changes after order submission may not always be possible.

2.2 Alternative ways to order. If you prefer not to order online, you can place an order by contacting our team:

We will guide you through the process, confirm availability and pricing, and process your order after receiving your confirmation.

2.3 Order confirmation & contract formation. Your order is a binding offer from you to purchase the selected products at the displayed price.

After submission, you will receive an automatic email confirming receipt of your order (this is not acceptance).

A legally binding contract is formed only when we send you a second email confirming that your product(s) have been dispatched (or, for pre-order/custom items, when we confirm they are ready for shipment).

The confirmation email will include your order number, please quote this in any communication with us regarding your order.

2.4 Who can place an order. To place an order you must be at least 18 years old and authorised to use the chosen payment method.

If you are under 18, you may place an order only with the involvement and explicit consent of a parent or legal guardian.

2.5 Prices & payment methods. All prices displayed on the Website are in Romanian Leu (RON) and include 21% VAT unless otherwise stated.

We accept the following payment methods:

  • Online card payment (Visa, Mastercard, etc.) via secure processor
  • Bank transfer (in advance – details provided after order confirmation)
  • Cash on delivery (ramburs) – additional fee may apply (currently +5 RON)

We are not responsible for any additional fees charged by your bank (e.g. currency conversion fees if your card is not in RON).

2.6 Order verification & preparation. All orders are verified by our team before dispatch. This includes checking stock availability, pricing accuracy, fraud prevention, and order details.

If we are unable to fulfil your order (e.g. item out of stock, pricing error, suspected fraud, or other valid reason), we will contact you promptly via email or phone and offer alternatives (replacement, waiting for restock, or full refund).

We reserve the right to cancel or refuse any order in the following situations (among others):

  • Failed/invalid transaction
  • Incomplete or incorrect information provided by you
  • Activity that may affect the functioning of the Website or our business
  • Reasonable suspicion of fraud or abuse (e.g. repeated order cancellations without payment)

By placing an order you confirm that you have read, understood and agree to these Terms and Conditions.

3. Use of the Website and Electronic Services

3.1 Shopping Cart. The shopping cart functionality begins when you add the first product to your cart.

The cart is provided free of charge, is for single use per order/session and concludes when you place an order through it or when you abandon it. The cart saves your selected items even after the browser session ends, but does not reserve stock: availability is confirmed only at order verification/processing.

3.2 Your obligations. When using the Website, cart, checkout, account features, contact forms or any other electronic services, you agree to:

  • Provide truthful, accurate and complete information when placing an order or creating an account
  • Keep your data up to date (especially delivery address, contact details), you can modify information during checkout before confirming
  • Use the Website and its services in a way that does not interfere with its operation, security or other users
  • Comply with applicable laws and these Terms
  • Pay the price and any associated costs on time
  • Take delivery of ordered products (especially important for cash on delivery)
  • Not engage in any unauthorised activities such as attempting to obtain data not intended for you, interfering with the technical functioning of the site, modifying content, prices or product descriptions without authorisation, or any other actions that could harm the Website or our business

3.3 Complaints about electronic services. If you have a complaint regarding the functioning of the Website, electronic services, cart, checkout, login, forms or any other digital feature, you may submit it:

  • Description of the issue and circumstances (type of problem, date/time it occurred)
  • Your request / desired solution
  • Your contact details

These are recommendations: complaints submitted without this information will still be processed, but including details helps us resolve your issue faster.

We will respond to complaints about electronic services within 30 calendar days from receipt.

4. Our Products

4.1 What we provide. We supply motorsport and automotive-related products, including vehicle parts, performance components, accessories and related goods available for purchase through our Website.

4.2 Descriptions and images. Product images and descriptions are for illustrative purposes only. While we make every effort to ensure accuracy, we cannot guarantee that the appearance on your device exactly matches the actual product.

Technical details (compatibility, fitment) should be carefully reviewed before ordering. If you are unsure whether a product is suitable for your vehicle, please contact us prior to purchase.

4.3 Availability. All products are subject to availability. If a product becomes unavailable after order placement, we will inform you as soon as possible and offer alternatives or a full refund.

5. Delivery

5.1 Delivery areas. We deliver throughout Romania and, in certain cases, internationally, using trusted courier partners.

5.2 Estimated delivery time. We aim to deliver within approximately 2 working days from order confirmation, depending on courier and destination.

The timeframe includes preparation and courier delivery time. Estimated dates may vary during busy periods or due to events beyond our control. The estimated timeframe will be communicated in the order confirmation email.

5.3 Maximum delivery period. The maximum delivery period is 30 calendar days from the conclusion of the distance contract.

If delivery is not made within the indicated timeframe, you may request additional delivery within 5 working days. If still not delivered, you may terminate the contract and request a full refund.

5.4 Dispatch. Orders placed before 16:00 on business days are generally dispatched the same day. Orders placed after this time are processed the next business day.

5.5 Delivery charges. Standard delivery costs for parcels up to 1 kg are typically between 17–23 RON, depending on courier and area.

Final shipping costs (based on weight, size, destination) are displayed clearly during checkout before confirmation.

5.6 Free delivery. We offer free delivery for orders exceeding 700 RON (except when total weight exceeds 15 kg).

5.7 Delivery conditions. The courier may contact you in advance to confirm availability. You are responsible for being present at the delivery address during the communicated window.

If you are unavailable and a second attempt is required, you may be charged additional transport costs.

If you cannot receive the parcel personally, it may be handed to another person aged 18+ who knows the order number.

For deliveries to workplaces, you must ensure courier access.

5.8 Availability issues. If a product becomes unavailable after order confirmation (including changes in price/characteristics), we will inform you immediately. If payment was made in advance, the amount will be refunded within 14 calendar days.

5.9 Complaints about delivery or products. Product images are illustrative; packaging may vary by manufacturer.

We are legally obliged to deliver conforming products. A product is conforming if it:

  • Matches the description on the Website
  • Is fit for normal use of similar products
  • Meets reasonable quality and performance expectations

If a product is defective or non-conforming upon delivery, you may request:

  • Repair
  • Replacement
  • Price reduction
  • Contract termination (in case of serious non-conformity)

5.10 Submitting a complaint. Complaints can be submitted by email to: contact@senditmotorsport.com

We recommend including:

  • Order number
  • Description of the defect/issue
  • Date discovered
  • Preferred solution (repair, replacement, refund)

We will respond within 10 working days and keep you updated by email/phone.

If inspection is required, return shipping will be covered by us in justified cases.

Resolution (including repair/replacement) may take up to 30 calendar days, depending on the issue and required cooperation.

6. Your Right to End the Contract (Distance Sales: Returns & Payment)

6.1 Formation of the distance contract. The distance sales contract is concluded when we confirm by email the placement of your order and product availability.

6.2 Ending the contract. You may end the contract at any time. Your rights depend on the reason, whether the product is faulty, our performance, and timing.

We are legally obliged to supply conforming products. Nothing in these Terms affects your statutory consumer rights.

6.3 Faulty, damaged or misdescribed products. If the product is faulty, damaged, or substantially different from the description, you have legal rights to end the contract, request replacement, or receive a refund.

In such cases, returns within Romania are free of charge if made within 14 days from delivery (unless otherwise stated).

6.4 Ending the contract due to our fault. You may end the contract immediately and receive a full refund for undelivered products if:

  • We inform you of a product/Terms change you do not accept
  • We inform you of a pricing/description error and you do not wish to proceed
  • We inform you of significant delivery delay due to events outside our control
  • We suspend supply for technical reasons for more than four weeks
  • You have a legal right to end due to our fault

6.5 Changing your mind (14-day withdrawal right) As a consumer, you have the right to withdraw from the contract without reason within 14 calendar days from receiving the product (or last item in partial deliveries).

To exercise this right, inform us unequivocally (by email to contact@senditmotorsport.com or contact form) before the 14-day period expires.

You must return the products within another 14 days after notification.

Products must be returned:

  • Unused, in original condition, with all labels, packaging, manuals, and accessories
  • Using the method we specify

Return shipping costs are your responsibility unless the return is due to our error.

6.6 Exceptions to withdrawal right. You do not have the right to withdraw for:

  • Custom-made or personalised products (e.g. engraved parts, custom ECU tunes)
  • Sealed goods unsealed after delivery for hygiene/safety reasons (e.g. helmets, gloves, fluids, filters after use)
  • Digital content (if you started downloading/streaming with prior consent and waived withdrawal)

6.7 Payment methods and card security. We accept:

  • Online card payment via secure processor
  • Bank transfer (in advance)
  • Cash on delivery (ramburs) – additional fee may apply

Card payments are processed securely. We do not store full card details. If you refuse to pay or accept a COD parcel, the contract is terminated and we are released from further delivery obligation.

7. Returns and Refunds

7.1 How to contact us about returns or complaints. Contact our customer service team:

Please include: full name, delivery address, order number, email address, and photos/description of the issue.

7.2 Returning products. If you end the contract after dispatch/delivery, you must return the products.

Return procedure is detailed in our Returns Policy. You may be asked to provide:

  • Product details
  • Reason for return
  • Additional information/photos

Return products:

  • In original condition (unused, complete)
  • Using our specified method/courier
  • Within 14 calendar days from withdrawal notification (for change of mind) or warranty period (for defects)

Return shipping costs are your responsibility unless due to our error.

7.3 Refunds. After receiving and verifying returned products, we will refund:

  • Full price paid (including standard delivery costs if applicable)
  • Using the original payment method

Refunds are processed as soon as possible, within 14 days from receipt of returned goods (or proof of shipment).

Notes:

  • Discount/promotion refunds may reflect original benefit
  • We are not responsible for bank fees
  • COD refunds are made by bank transfer

7.4 Warranty information. Products benefit from the legal warranty of conformity (minimum 2 years for new products).

For items with manufacturer warranty (e.g. performance parts, electronics), you will receive a warranty certificate upon delivery containing:

  • Warranty duration
  • Conditions
  • Manufacturer/supplier contact

Warranty covers manufacturing defects and non-conformity. It does not cover misuse, improper installation, accidents, unauthorised modifications, or normal wear.

To claim warranty:

  • Contact us within the warranty period
  • Provide proof of purchase, photos of defect, and warranty certificate
  • Return product for inspection (we cover return shipping if valid)

We will repair, replace or refund (at our discretion) in accordance with law and manufacturer policy.

7.5 Exceptions to returns. No right of withdrawal for:

  • Custom-made/personalised items
  • Sealed goods unsealed for hygiene/safety reasons
  • Digital content (with prior consent and waiver)

8. Our Rights to End the Contract

8.1 We may end the contract. We may end the contract by writing to you if:

  • You do not provide necessary information (e.g. delivery address) in reasonable time
  • You do not allow delivery in reasonable time

8.2 Refunds. If we end the contract under these circumstances, we will refund any advance payments for undelivered products.

9. Price and Payment

9.1 Price The price is the one displayed at checkout when you place your order. Prices include 21% VAT unless stated otherwise.

9.2 Changes to price. We may update prices. The price at order placement applies to your purchase.

9.3 Pricing errors. If we discover an obvious pricing error:

  • Lower correct price → we charge the lower amount
  • Higher correct price and obvious error → we may cancel and refund

9.4 Payment methods. We accept online card payments, bank transfer, and cash on delivery (additional fee may apply).

We do not store full card details.

9.5 Invoicing. We issue fiscal invoices. They are sent electronically or included in the package.

10. Our Responsibility for Loss or Damage

10.1 Foreseeable loss. We are responsible for foreseeable loss caused by our breach or negligence.

10.2 Exclusions. We are not liable for unforeseeable loss, or business losses (profit, interruption) if products are used commercially.

10.3 Non-excludable liability. Nothing limits liability for death/injury from negligence, fraud, or mandatory consumer rights.

11. How We Use Your Personal Information

We process personal data in accordance with GDPR and Romanian law.

Purposes include:

  • Order processing and delivery
  • Customer support
  • Invoicing and legal obligations
  • Returns, refunds, warranty
  • Website/service improvement
  • Marketing communications (with consent or legal permission)

Scope covers all data processed by us, regardless of location.

We retain data only as long as necessary (storage limitation principle).

12. Other Important Terms

12.1 Transfer of contract. We may transfer our rights/obligations to another organisation. We will notify you. Your rights remain unaffected. If unhappy, contact us within 7 days to end the contract and receive refund for undelivered products.

12.2 You cannot transfer rights. You may only transfer your rights/obligations with our written consent.

12.3 No third-party rights. This contract is between you and us only.

12.4 Changes to Terms. We may update Terms to reflect legal/business changes. Version at order placement applies.

12.5 Invalid provisions. If any part is unlawful, remaining provisions remain in force.

12.6 Delay in enforcement. Delay in enforcing rights does not waive them.

13. Governing Law and Dispute Resolution

13.1 Governing law. These Terms, any contract and related disputes are governed by the laws of Romania and applicable EU consumer protection legislation.

13.2 Dispute resolution. We prefer amicable resolution. Contact support first.

If unresolved, disputes are submitted to the competent courts of Romania (jurisdiction over our registered office in Ilfov/Bucharest, unless mandatory consumer rules apply).

13.3 Alternative dispute resolution (ADR) for consumers. If you are a consumer (a natural person acting outside your trade, business, craft, or profession), you also have the right to use out-of-court dispute resolution mechanisms. You may submit your complaint to:

  • The European Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr/ This is an EU-wide portal that allows you to submit disputes related to online purchases to certified ADR bodies.
  • The National Authority for Consumer Protection (ANPC) in Romania at: www.anpc.ro

We are not obliged to participate in ADR procedures but will consider any reasonable request to do so.

Nothing in these Terms affects your statutory rights as a consumer, including your right to take legal action or use alternative dispute resolution options.
